Bankruptcy is a legal process for individuals unable to repay their debts, where an Official Receiver or trustee is appointed to manage the case.
The process involves declaring insolvency, where your assets may be sold to repay creditors, and you may need to make contributions from your income if you can afford it.
Bankruptcy typically lasts for one year, after which remaining unsecured debts are often written off, though it will affect your credit rating for six years.
While under bankruptcy, there are restrictions on financial activities, such as not being able to act as a company director or obtain significant credit without disclosing your bankruptcy.

Which debts can be included in bankruptcy?
Most of your unsecured debts such as credit cards, personal loans, payday loans, catalogue debts, store cards and overdrafts can all be included in the bankruptcy. Additionally, HMRC Tax or VAT debts for which you are personally responsible, council tax arrears, utility bill arrears, gambling debts, outstanding balances after home or vehicle repossession, benefits overpayments (unless due to fraud) and business loans for which you are personally responsible can also be included in bankruptcy.
How long does bankruptcy last?
Bankruptcy usually lasts for a year, after which time the debts within the bankruptcy will be written off.
What’s The Cost to File Bankruptcy?
The cost to file Bankruptcy is £680. This fee can be paid all in one go or through instalments. The minimum amount you can pay periodically for Bankruptcy is £5 and, in theory, you can make as many payments as you need to cover the cost to suit your needs.
How long does Bankruptcy stay on your credit report?
Details of Bankruptcy will stay on your credit report for six years after the date the Bankruptcy order was granted. During this time, and while rebuilding your credit score, you are likely to find it very difficult to obtain additional lending or other financial products.
What are the alternatives to bankruptcy?
You may still qualify for several other debt solutions that could help you to avoid the serious consequences of bankruptcy, including:
- Individual Voluntary Arrangement (IVA) – this is a debt solution that allows you to keep your home, whilst making reduced and affordable debt repayments usually over 5 to 6 years – after which time your outstanding debts are written off. It is a legally binding agreement.
- Debt Management Plan (DMP) – this is a less formal way of repaying your debts in which you make reduced payments to your creditors based on what you can afford. The DMP lasts until you have repaid your debts in full, or until your circumstances improve.
- Debt Relief Order (DRO) – this is similar to bankruptcy but for those who have assets worth less than £2,000 or have a surplus of less than £75 per month. A DRO lasts for one year and after that period your debts will be written off.

Eligibility of Bankruptcy.

You must be unable to pay your debts as they come due. This means your debts exceed your assets and you can't manage to make payments.
Debt Level:
There is no minimum debt amount required, but you should have enough debt to justify the process.
Residency:
You must be a resident of the UK or have lived or carried on business in the UK in the last 12 months.
Previous Bankruptcies:
If you’ve been bankrupt before, there might be additional considerations. If you’ve been bankrupt within the last 6 years, there are restrictions on your ability to file again.
Certain Restrictions:
Some people are not eligible, such as those currently subject to an Individual Voluntary Arrangement (IVA) or a Debt Relief Order (DRO).
